Procedures for determining breaches of the code of conduct

All Australian Public Service (APS) employees must follow the APS Code of Conduct. In accordance with the Act, the Inspector-General of Aged Care has set up procedures for deciding whether a current or former employee has breached the code and deciding sanctions.

APS Code of Conduct

The APS Code of Conduct sets out the behavioural standards expected of APS employees, as stated in section 13 of the Public Service Act 1999 (Act). The Act requires the head of each agency to establish procedures for determining whether an employee has breached the code and what sanction, if any, is to be imposed if a breach is found.

In accordance with section 15 (3) of the Act, the Inspector-General, as the agency head of the OIGAC, has established procedures for determining whether an APS employee, or former employee, of the agency has breached the Code of Conduct, and for determining sanctions.

We make these procedures publicly available in accordance with section 15 (7) of the Act: 'An Agency Head must ensure that the procedures established under subsection (3) are made publicly available'.
